DATA PROTECTION AND PRIVACY POLICY
This Privacy Policy aims to inform users about the handling of personal data collected through the website, the Consumer Portal, and any other platform provided on the website of the National Consumer Service, in compliance with the personal data protection regulations governed by various legal bodies. In fact, its regulatory framework consists, among others, of Law N° 19,628 of 1999, on the Protection of Private Life; as established in Article 19 Nº4 of the Political Constitution of the Republic; Law N° 20,285, on Access to Public Information; Law N° 20,575, which Establishes the Principle of Purpose in the Processing of Personal Data; and Decree N° 779 of 2000, from the Ministry of Justice, which Approves the Regulation of Personal Data Banks Managed by Public Organizations. In addition, this regulation is complemented by the Recommendations of the Council for Transparency on the Protection of Personal Data by State Administration Bodies, published in the Official Gazette on September 14, 2011.
Responsibility of the National Consumer Service for data usage
FACTORIT will adopt the necessary security measures to ensure the confidentiality of data collected through forms, surveys, or web browsing registration mechanisms. The Service and its officials, who might interact with personal data at any time, are obliged to maintain the confidentiality of such data, especially if they originate from or have been collected from sources not accessible to the public. This obligation persists indefinitely, even after ending their relationship with the Service.
For the purposes of this “Privacy Policy”, “User” refers to the person who voluntarily registers on www.factorit.com through specifically designated forms. Meanwhile, “Visitor” refers to someone who freely accesses the information available on www.factorit.com without prior registration.
Data provided by users of the website www.factorit.com will be managed exclusively by officials of the National Consumer Service, preventing misuse, alteration, or third-party access. Notwithstanding, FACTORIT will not be responsible for the use third parties may make of personal data shared by its holders in public spaces, such as social networks or forums.

Should an external entity or company manage the databases collected through www.factorit.com under a service contract, the Service will sign a confidentiality agreement. Under no circumstances can the company or entity commercialize, use, or provide users’ personal data to third parties.
Ways of collecting data
Automatic: Electronic processes recording general user activities and behaviors within a website without personal identification. Examples include: number of website visitors, login times, most viewed pages, and number of pages viewed.
Demographic and Interest Data: Estimated data such as age, gender, and interests obtained through navigation analysis, remarketing, and advertising report functions performed by Google Analytics for user accounts that authorize it in their respective browsers.
Direct Input: Direct requests for information from visitors or website users through forms, selection buttons, or similar, collecting data such as name, identity card number, email, occupation, or other personal details.
Cookies: Files stored on a user’s device when browsing the Internet. They contain a unique number identifying the user’s device, even if its location or IP address changes. Cookies tailor web content to user profiles and needs.
Use of information
Users’ personal data will only be used for the purposes stated in the relevant form(s) and strictly within the competencies and attributions of the National Consumer Service. Personal data processing will be justified in the exercise of the consumer protection, aiming to equip them with tools to exercise their rights.
In the development of each of the platforms provided by the Service, such as complaints entry, forms, surveys, market research, etc., users will be promptly informed whether answers are mandatory or optional. They will also be informed of the purpose for which the information is being requested. If a different data treatment than the one specified is ever required, the holder’s consent must be recorded.
Personal data disclosed in public systems, such as social networks or forums related to the FACTORIT website, will be stored along with other content to allow system functionality, maintenance, and transparency. Such data will not be used by the Service or its officials for different purposes without prior consent from the holder.
Personal data collected through www.factorit.com and related sites will be stored only as long as necessary to provide the service or fulfill the purpose for which they were collected.
Use for statistical purposes: Data collected through the website can be stored and processed for statistical purposes as long as the identification of its holders is impossible.
Transfer of information to Public Institutions or Services: The transfer of information to other public institutions or services can take place as long as the communication or transfer of data is necessary for the fulfillment of legal functions. Both bodies must act within their legally established faculties. Information or personal data can be transferred or shared as long as it is necessary for the processing that aims to grant benefits to the holder, avoid duplicate procedures, or repeated requests for information or documents for the holders. Such transfer or sharing must maintain compliance with the principles of legality, coordinated action of the State Administration Bodies, fulfillment of the public entity’s purpose, the obligation of confidentiality and reservation, and other obligations established in Law Nº19,628 and Law Nº20,285.
Accuracy of data
The provided information and data must be accurate and, if necessary, updated. The entity in charge of processing won’t be accountable as long as it has taken all reasonable steps to delete or rectify any inaccuracies in the personal data regarding their purpose, in cases where the inaccurate data:

- a) Were obtained by FACTORIT directly from the consumer.
- b) Were obtained by the entity in charge from a mediator or intermediary, in cases where the rules applicable to the sector of activity to which the entity belongs allowed the intervention of a mediator or intermediary to collect the data from the affected parties on their behalf and transmit it to the entity in charge. The mediator or intermediary will assume any responsibilities that may arise from communicating inaccurate data to FACTORIT.

The visitor or user can request FACTORIT, at any time, to correct, delete, or modify their personal data that they have provided through the Consumer Portal. Likewise, they can oppose or cancel the consent they have given to store or process their data. The visitor or user can make the requests mentioned above by sending an email to the address info@factorit.com, specifying the subject “Change of personal data”.
